Photography Services Contract
This Agreement is entered into on date (the “Effective Date”), by and between:
1. Parties
Photographer: legal business name, with a mailing address of photographer address (“Photographer”); and
Client: client full name, with a mailing address of client address (“Client”). Together, the “Parties”.
2. Services and Scope of Coverage
The Photographer agrees to provide photography services for the Client’s event/session on event date, at venue / location(s). Coverage begins at start time and ends at end time, for a total of number hours of coverage.
Included personnel and services: describe included personnel and services. Any addition to this scope requires written approval by both Parties and may incur additional fees. The Photographer does not guarantee any specific photograph, guest, or moment unless listed here in writing.
3. Deliverables
The Client will receive approximately number edited, high-resolution JPEG images, delivered via a private online gallery within delivery timeframe of the event date. RAW or unedited files are not included and are not delivered unless purchased separately in writing. Gallery access is provided for access period; the Client is responsible for downloading and backing up all files upon delivery.
4. Fees and Payment Schedule
The total fee for the Services is $total (the “Total Fee”). The remaining balance is due no later than balance due date. Accepted payment methods: payment methods. Late payments incur a fee of $amount per period of delay. Deliverables are not released until the Total Fee is paid in full.
5. Booking Fee
To reserve the date, the Client pays a non-refundable booking fee of percentage or amount of the Total Fee upon signing this Agreement. This fee compensates the Photographer for reserving the date and declining other work, and is not refundable for any reason, including cancellation by the Client.
6. Cancellation and Rescheduling
Cancellation. If the Client cancels, the booking fee is retained. In addition: cancellations made 30 days or more before the event receive a refund of amounts paid beyond the booking fee; cancellations made 15–29 days before the event receive a 50% refund of amounts paid beyond the booking fee; cancellations made fewer than 15 days before the event receive no refund.
Rescheduling. A request to change the date is a rescheduling — not a cancellation — only if the Photographer confirms availability for the new date in writing. If the Photographer is not available, the request is treated as a cancellation under this section.
Cancellation by the Photographer. If the Photographer must cancel, all monies paid, including the booking fee, are refunded in full, and the Photographer will make reasonable efforts to help the Client find a comparable replacement photographer.
7. Overtime
Coverage beyond the hours stated in Section 2 is billed at $your hourly rate per additional hour, payable before delivery of the final images.
8. Copyright
The Photographer retains full copyright and ownership of all images created. No transfer of copyright is implied or granted by this Agreement or by payment of the Total Fee.
9. Client Usage License
The Photographer grants the Client a non-exclusive, perpetual license to print, share and display the delivered images for personal, non-commercial purposes. Any commercial use, sale, or transfer of the images requires the Photographer’s prior written consent.
10. Releases
If the images will be used for advertising, portfolio promotion, or publication, or if they feature private property or third parties, the Parties will execute the appropriate model release or property release.
11. Editorial Discretion
Image selection, editing style and final retouching remain within the Photographer’s professional judgment. The Client may not alter, crop, filter or otherwise modify the delivered images without the Photographer’s consent.
12. Limitation of Liability
Except in cases of gross negligence or willful misconduct, the Photographer’s total liability for any claim arising from this Agreement is limited to the total amount paid by the Client under this Agreement.
13. Image Loss and Equipment Failure
The Photographer takes reasonable precautions, including backup equipment and redundant file storage. In the unlikely event of technical failure, theft or data loss resulting in partial or total loss of images, the Photographer’s liability is limited to a partial or full refund, proportionate to the loss. No additional compensation is owed.
14. Cooperation and Interference
The Photographer is not responsible for missed coverage caused by guest interference, venue rules, or restrictions imposed by officiants, planners or staff. The Client agrees to communicate to guests and vendors that the Photographer has priority for key moments, and to provide reasonable cooperation, including a point of contact and any requested shot list before the event.
15. Indemnification
The Client agrees to indemnify and hold harmless the Photographer from any liability, damage or claim arising from the actions of the Client or the Client’s guests during the event. The Photographer likewise indemnifies the Client for damages resulting from the Photographer’s own actions in the course of the Services.
16. Dispute Resolution
The Parties agree to attempt mediation before any litigation. Any dispute not resolved by mediation will be submitted to binding arbitration or the courts of county, state, whose laws govern this Agreement.
